In order to prevent the fragmentation of agricultural lands
by inheritance and sales the use of agricultural lands for non-agricultural
purposes, Turkey has established the Law No. 6537 concerning Soil Conservation
and Land Use. Therefore, the Ministry of Agriculture and Forestry has in charge
the attribution and information for relevant units of agricultural land in
order to transfer the property both from sales and inheritance. Accordingly,
the transfer of land takes into consideration the land size limitations, such
as minimum agricultural land, sufficient agricultural income and economic
integrity. However, the applicants for
the sale permit face many difficulties in determining the land size limits as
well as the transfer to inheritance encounters many disputes. So, this
situation makes the implementation of the inheritance Law complicated and
becomes prominent issue which requires urgent solution in the country's agenda.
This study aims to evaluate the causes of disputes over land transfer and to
suggests solutions to resolve land ownership’s issues. Primary data through
survey was used in the current research and the findings reveal that the main
disagreements arise from the existing law in the province of Antalya.
